Abstract: This casebook presents a deep comparative analysis of property law systems in Europe (ie the law of immovables, movables and claims), offering signposts and stepping stones for the reader wishing to explore this fascinating area. The subject matter is explained with careful attention given to its history, foundations, thought-patterns, underlying principles and basic concepts. The casebook focuses on uncovering differences and similarities between Europe's major legal systems: French, German, Dutch and English law are examined, while Austrian and Belgian law are also touched upon. The book combines excerpts from primary source materials (case law and legislation) and from doctrine and soft law. In doing so it presents a faithful picture of the systems concerned.Separate chapters deal with the various types of property rights, their creation, transfer and destruction, with security rights (such as mortgages, pledges, retention of title) as well as with harmonising and unifying efforts at the EU and global level. Through the functional approach taken by the Ius Commune Casebooks this volume clearly demonstrates that traditional comparative insights no longer hold. The law of property used to be regarded as a product of historical developments and political ideology, which were considered to be almost set in stone and assumed to render any substantial form of harmonisation or approximation very unlikely. Even experienced comparative lawyers considered the divide between common law and civil law to be so deep that no common ground - so it was thought - could be found. However economic integration, in particular integration of financial markets and freedom of establishment, has led to the integration of particular areas of property law such as mortgage law and enforceable security instruments (eg retention of title). This pressure towards integration has led comparative lawyers to refocus their interest from contract, tort and unjustified enrichment to property law and delve beneath its surface.This book reveals that today property law systems are closer to one another than previously assumed, that common ground can be found and that differences can be analysed in a new light to enable comparison and further the development of property law in Europe.

Abstract: Spain and Italy have recently become countries of large-scale immigration. This provocative book explores immigration law and the immigrant experience in these southern European nations, and exposes the tension between the temporary and contingent legal status of most immigrants, and the government emphasis on integration. This book reveals that while law and the rhetoric of policymakers stress the urgency of integration, not only are they failing in that effort, but law itself plays a role in that failure. In addressing this paradox, the author combines theoretical insights and extensive data from myriad sources collected over more than a decade to demonstrate the connections among immigrants' role as cheap labor - carefully inscribed in law - and their social exclusion, criminalization, and racialization. Extrapolating from this economics of alterité, this book engages more general questions of citizenship, belonging, race and community in this global era.

Oscar Sanchez-Sibony challenges the idea that the Soviet Union represented a parallel socio-economic construct to the liberal world economy. Instead he shows that the USSR, a middle-income country more often than not at the mercy of global economic forces, tracked the same path as other countries in the world, moving from 1930s autarky to the globalizing processes of the postwar period. In examining the constraints and opportunities afforded the Soviets in their engagement of the capitalist world, he questions the very foundations of the Cold War narrative as a contest between superpowers in a bipolar world. Far from an economic force in the world, the Soviets managed only to become dependent providers of energy to the rich world, and second-best partners to the global South.

Abstract: Women Migrants from East to West documents the contemporary phenomenon of the feminisation of migration through an exploration of the lives of women who have moved from Bulgaria and Hungary to Italy and the Netherlands. The research is based on the oral histories of eighty migrant women and thirty additional interviews with 'native' women in the 'receiving' countries. The research assumes migrants to be active subjects, creating possibilities and taking decisions in their own lives, as well as being subject to legal and political regulation, and the book analyses the new forms of subjectivity that come about through mobility. Part I is a largely conceptual exploration of subjectivity, mobility and gender in Europe. The chapters in Part II focus on love, work, home, communication, and food, themes which emerged from the migrant women's accounts. In Part III, based on the interviews with 'native' women - employers, friends, or in associations relevant to migrant women - the chapters analyse their representations of migrants, and the book goes on to explore forms of intersubjectivity between European women of different cultural origins. A major contribution of this book is to consider how the movement of people across Europe is changing the cultural and social landscape with implications for how we think about what Europe means.

Why were nearly 10,000 people killed in six weeks in Hamburg, whilst most of Europe was left almost unscathed? As Richard J.Evans explains, it was largely because the town was a unique anomaly: a 'free city' within Germany governed by local notables who believed in the 'English' ideals of laissez-faire. Their failure to supply clean water, fresh air and pure food played a major role in the catastrophe. Their medical theories, influenced by political and economic interest, only made matters worse. The whole story of 'the cholera years' is tragically revealing of the age's social inequalities and administrative incompetence; it also offers some disquieting parallels with today's attitudes to AIDS.

Abstract: What is the relation between gestures and speech? In terms of symbolic forms, of course, the spontaneous and unwitting gestures we make while talking differ sharply from spoken language itself. Whereas spoken language is linear, segmented, standardized, and arbitrary, gestures are global, synthetic, idiosyncratic, and imagistic. In Hand and Mind, David McNeill presents a bold theory of the essential unity of speech and the gestures that accompany it. This long-awaited, provocative study argues that the unity of gestures and language far exceeds the surface level of speech noted by previous researchers and in fact also includes the semantic and pragmatic levels of language. In effect, the whole concept of language must be altered to take into account the nonsegmented, instantaneous, and holistic images conveyed by gestures. McNeill and his colleagues carefully devised a standard methodology for examining the speech and gesture behavior of individuals engaged in narrative discourse. A research subject is shown a cartoon like the 1950 Canary Row--a classic Sylvester and Tweedy Bird caper that features Sylvester climbing up a downspout, swallowing a bowling ball and slamming into a brick wall. After watching the cartoon, the subject is videotaped recounting the story from memory to a listener who has not seen the cartoon. Painstaking analysis of the videotapes revealed that although the research subjects--children as well as adults, some neurologically impaired--represented a wide variety of linguistic groupings, the gestures of people speaking English and a half dozen other languages manifest the same principles. Relying on data from more than ten years of research, McNeill shows that gestures do not simply form a part of what is said and meant but have an impact on thought itself. He persuasively argues that because gestures directly transfer mental images to visible forms, conveying ideas that language cannot always express, we must examine language and gesture together to unveil the operations of the mind.
