Abstract: Collaboration has become a popular approach to environmental policy, planning, and management. At the urging of citizens, nongovernmental organizations, and industry, government officials at all levels have experimented with collaboration. Yet questions remain about the roles that governments play in collaboration--whether they are constructive and support collaboration, or introduce barriers. This thoughtful book analyzes a series of cases to understand how collaborative processes work and whether government can be an equal partner even as government agencies often formally control decision making and are held accountable for the outcomes. Looking at examples where government has led, encouraged, or followed in collaboration, the authors assess how governmental actors and institutions affected the way issues were defined, the resources available for collaboration, and the organizational processes and structures that were established. Cases include collaborative efforts to manage watersheds, rivers, estuaries, farmland, endangered species habitats, and forests. The authors develop a new theoretical framework and demonstrate that government left a heavy imprint in each of the efforts. The work concludes by discussing the choices and challenges faced by governmental institutions and actors as they try to realize the potential of collaborative environmental management.

Abstract: As environmental challenges grow larger in scale and implications, it is increasingly important to apply the best scientific knowledge in the decisionmaking process. Editors Farrell and J?ger present environmental assessments as the bridge between the expert knowledge of scientists and engineers on the one hand and decisionmakers on the other. When done well, assessments have a positive impact on public policy, the strategic decisions of private firms, and, ultimately, the quality of life for many people. This book is the result of an international, interdisciplinary research project to analyze past environmental assessments and understand how their design influenced their effectiveness in bringing scientific evidence and insight into the decisionmaking process. The case studies in the book feature a wide range of regional and global risks, including ozone depletion, transboundary air pollution, and climate change. Assessments of Regional and Global Environmental Risks offers several important contributions. It provides a clear account of the choices faced in the design of environmental assessments and a clear description of the lessons learned from past assessments. It illustrates why assessments are social processes, not simply reports. And, while they identify no universal, one-size-fits-all design, the authors find that, to be effective, environmental assessments must be viewed by those who produce and use them as being salient; credible in their scientific support; and legitimate, or fair in design and execution.

Abstract: Il testo esamina la disciplina sulla bonifica dei siti contaminati riportata nella Parte quarta, Titolo V del Dlgs 152/2006, così come modificata dal Dlgs 4/2008, confrontandola con quella precedente di cui al Dm 471/1999. Il confronto è necessario in quanto la disciplina del Dm 471/1999 è stata vigente per circa 8 anni, e ha consentito la diffusione di una cultura seria in tema di bonifiche. Inoltre, alcuni criteri previsti nell'ex Dm 471/1999 continuano "di fatto" a vivere in base all'articolo 252-bis del Dlgs 4/2008, in relazione, nello specifico, ai casi di bonifiche ai fini di riconversione industriale di siti di preminente interesse pubblico. Viene poi presa in esame anche la questione delle "terre e rocce da scavo" (articolo 186, Parte quarta, Dlgs 152/2006), indicando soluzioni operative laddove queste debbano essere considerate rifiuti. Particolare attenzione viene riservata all'analisi di rischio igienico-sanitaria, di cui vengono illustrati gli aspetti normativi e tecnico-operativi. Il volume riporta poi tre appendici che illustrano le indicazioni di Apat e dell'Istituto superiore di sanità in merito alla validazìone dei dati di caratterizzazione di un sito, all'individuazione dei valori del fondo naturale/antropico per i parametri inorganici e alla procedura di applicazione dell'Adr ai suoli agricoli, di estrema utilità nel caso in cui si debba procedere a una valutazione del rischio sanitario connesso a questi terreni.

Abstract: The publication reviews a selection of transboundary governance systems from around the world tackling the issue of shared resources and environmental impacts affecting them. Given that political boundaries generally do not neatly mirror the borders of naturally-occurring systems such as water and air resources, ecosystems or migratory species patterns, there is a growing appreciation of the need for collective international action in addressing shared resources. Recent years thus have seen the expansion of a collection of agreements and mechanisms for addressing transboundary resources, many of which have had to navigate complicated sovereignty, political and jurisdictional difficulties in addition to already-challenging environmental science and policy questions necessitating their creation.

Abstract: This report inventories and analyses the range of international laws that protect the environment during armed conflict. With a view to identifying the current gaps and weaknesses in this system, the authors examine the relevant provisions within four bodies of international law - environmental humanitarian (IHL), international criminal law (ICL), international environmental law (IEL), and international human rights law (HRL). The report concludes with twelve concrete recommendations on ways to strengthen this legal framework and its enforcement. The Environment and Natural Resources are crucial for building and consolidating peace, it is urgent that their protection in times of armed conflict be strengthened. There can be no durable peace if the natural resources that sustain livelihoods are damaged or destroyed. This report provides a basis upon which Member States can draw upon to clarify, expand and enforce international law on environmental protection in times of war.
